第504条 侵犯版权的补救方法:损害赔偿和利润
(a)总则——除本法另有规定外,版权侵犯者有责任赔偿——

(2)(c)款所规定的法定损害赔偿。
(b)实际损害和利润——版权所有者有权要求赔偿其由于版权受到侵犯所蒙受的实际损害,以及版权侵犯者由于侵犯其版权所获得的没有计算在实际损害中的利润 。在确定版权侵犯者的利润时,只要求版权所有者提供有关版权侵犯者的总收入的证据,同时要求版权侵犯者证明其可扣除的费用,以及由于有版权的作品以外的其他因素所获得的利润。
(c)法定损害赔偿——
(1)除本款第(2)项另有规定外,版权所有者在终局判决作出以前的任何时候,可要求赔偿诉讼中涉及的任何一部作品版权侵犯行为的法定损害赔偿,而不是要求赔偿实际损害和利润。此项法定损害赔偿的金额,每部作品至少不低于250美元,最多不超过l万美元,由法院酌情判定。赔偿金可以由任何一个侵犯者单独承担,或者由任何两个或两个以上的侵犯者共同承担。为了本款的目的,一部编辑作品或演绎作品的所有部分构成一部作品。
(2)在版权所有者承担举证责任的情况下,如果法院判定侵犯版权是故意的 ,法院可酌情决定将法定损害赔偿金增加到不超过5万美元的数额。在版权侵犯者承担举证责任的情况下,如法院判定这个版权侵犯者不知道也没有理由认为其行动构成对版权的侵犯,法院可酌情决定将法定损害赔偿金减少到不少于100美元的 数额。在任何情况下,如果一个版权侵犯者认为共有合理根据认为其使用有版权作品根据第107条的规定是合理使用,法院应豁免法定损害赔偿金,但该版权侵犯者应属于以下范围:(Ⅰ)一个非营利的教育机构、图书馆或档案馆的雇员或代理人在其工作范围内;或这类教育机构、图书馆或档案馆本身,由于把著作复制成复制件或录音制品而侵犯了版权;或者(Ⅱ)一个公共广播台或一个人,作为公共广播台的非营利活动的经常部分(如第118条(g)款所规定的),演出一部已出版的非戏剧性文学作品或复制包含这一作品的表演的广播节目而侵犯了版权。
