保證書由專業律師幫助撰寫，並經雙方簽字認可，必要時可請無利害關系第專三方作證。保證書具有屬法律效力，可以向法院起訴，要求其履行約定。只要是由雙方簽字的文字證明，同時是在雙方自願的情況下簽署的。在法律上都可以作為有效的依據。如果再有律師見證的話，那就和法律文書具有一樣的效力。

『肆』 獨立完成作業的保證書怎麼寫

1.寫明沒完成作業的理由
2.已經意識到了沒完成作業的錯誤，並且非常後悔
3.立下保證，以後一內定努力學習容，認真獨立完成作業

『陸』 承諾書和保證書哪個有法律效力

保證書或者承諾書自願簽訂的，而且符合條件的，均是具有法律效力的。

承諾書和保證書都是是合同的一種，當然具有法律效力。有效的承諾書或者保證書必須同時滿足以下三個條件：

1. 是當事人真實意願的反映。承諾書或者保證書的內容應當是當事人內心真實意思的表達，不能被強迫或威脅或利誘、欺騙等。

2. 沒有違反相關法律規定，承諾書或者保證書的內容必須合乎法律的規定，不能違反法律或行政法規的禁止性規定，否則可能導致承諾書無效。

3. 沒有侵犯他人利益。承諾人只能基於自己有權處分的物進行處分，而不能因此侵犯到了他人的合法利益。

保證書是個人、集體、單位，為響應上級號召開展工作、完成任務或做錯了事，犯了錯誤並決心改正面提出保證時使用的專用書信信或文字材料。

『捌』 保證書有法律效力嗎

這個保證書是不具備法律效力的，案例之中你的合同與保證書是相互獨立的兩個法律依據，合同具備法律效力，而保證書獨立於合同之外，不具備與合同同等的法律效力，並且因為這個保證書侵害了你個人的正當合法利益，因此並不具備任何法律效力，這是我們通俗說法中的「霸王條款」，你可以不予接受，即使你接受了，一樣不具備法律效力。這你大可放心。
