《最高人民法院關於審理專利糾紛案件適用法律問題的若干規定》已於2001年6月19日由最高人民法院審判委員會第1180次會議通過,現予公布,自2001年7月1日起施行。

為了正確審理專利糾紛案件,根據《中華人民共和國民法通則》(以下簡稱民法通則)、《中華人民共和國專利法》(以下簡稱專利法)、《中華人民共和國民事訴訟法》和《中華人民共和國行政訴訟法》等法律的規定,作如下規定:
第一條 人民法院受理下列專利糾紛案件:
1、專利申請權糾紛案件;
2、專利權權屬糾紛案件;
3、專利權、專利申請權轉讓合同糾紛案件;
4、侵犯專利權糾紛案件;
5、假冒他人專利糾紛案件;
6、發明專利申請公布後、專利權授予前使用費糾紛案件;
7、職務發明創造發明人、設計人獎勵、報酬糾紛案件;
8、訴前申請停止侵權、財產保全案件;
9、發明人、設計人資格糾紛案件;
10、不服專利復審委員會維持駁回申請復審決定案件;
11、不服專利復審委員會專利權無效宣告請求決定案件;
12、不服國務院專利行政部門實施強制許可決定案件;
13、不服國務院專利行政部門實施強制許可使用費裁決案件;
14、不服國務院專利行政部門行政復議決定案件;
15、不服管理專利工作的部門行政決定案件;
16、其他專利糾紛案件。
第二條 專利糾紛第一審案件,由各省、自治區、直轄市人民政府所在地的中級人民法院和最高人民法院指定的中級人民法院管轄。
第三條 當事人對專利復審委員會於2001年7月1日以後作出的關於實用新型、外觀設計專利權撤銷請求復審決定不服向人民法院起訴的,人民法院不予受理。
第四條 當事人對專利復審委員會於2001年7月1日以後作出的關於維持駁回實用新型、外觀設計專利申請的復審決定,或者關於實用新型、外觀設計專利權無效宣告請求的決定不服向人民法院起訴的,人民法院應當受理。
第五條 因侵犯專利權行為提起的訴訟,由侵權行為地或者被告住所地人民法院管轄。
侵權行為地包括:被控侵犯發明、實用新型專利權的產品的製造、使用、許諾銷售、銷售、進口等行為的實施地;專利方法使用行為的實施地,依照該專利方法直接獲得的產品的使用、許諾銷售、銷售、進口等行為的實施地;外觀設計專利產品的製造、銷售、進口等行為的實施地;假冒他人專利的行為實施地。上述侵權行為的侵權結果發生地。
第六條 原告僅對侵權產品製造者提起訴訟,未起訴銷售者,侵權產品製造地與銷售地不一致的,製造地人民法院有管轄權;以製造者與銷售者為共同被告起訴的,銷售地人民法院有管轄權。
銷售者是製造者分支機構,原告在銷售地起訴侵權產品製造者製造、銷售行為的,銷售地人民法院有管轄權。
第七條 原告根據1993年1月1日以前提出的專利申請和根據該申請授予的方法發明專利權提起的侵權訴訟,參照本規定第五條、第六條的規定確定管轄。
人民法院在上述案件實體審理中依法適用方法發明專利權不延及產品的規定。
第八條 提起侵犯實用新型專利權訴訟的原告,應當在起訴時出具由國務院專利行政部門作出的檢索報告。
侵犯實用新型、外觀設計專利權糾紛案件的被告請求中止訴訟的,應當在答辯期內對原告的專利權提出宣告無效的請求。
第九條 人民法院受理的侵犯實用新型、外觀設計專利權糾紛案件,被告在答辯期間內請求宣告該項專利權無效的,人民法院應當中止訴訟,但具備下列情形之一的,可以不中止訴訟:
(一)原告出具的檢索報告未發現導致實用新型專利喪失新穎性、創造性的技術文獻的;
(二)被告提供的證據足以證明其使用的技術已經公知的;
(三)被告請求宣告該項專利權無效所提供的證據或者依據的理由明顯不充分的;
(四)人民法院認為不應當中止訴訟的其他情形。
第十條 人民法院受理的侵犯實用新型、外觀設計專利權糾紛案件,被告在答辯期間屆滿後請求宣告該項專利權無效的,人民法院不應當中止訴訟,但經審查認為有必要中止訴訟的除外。
第十一條 人民法院受理的侵犯發明專利權糾紛案件或者經專利復審委員會審查維持專利權的侵犯實用新型、外觀設計專利權糾紛案件,被告在答辯期間內請求宣告該項專利權無效的,人民法院可以不中止訴訟。
第十二條 人民法院決定中止訴訟,專利權人或者利害關系人請求責令被告停止有關行為或者採取其他制止侵權損害繼續擴大的措施,並提供了擔保,人民法院經審查符合有關法律規定的,可以在裁定中止訴訟的同時一並作出有關裁定。
第十三條 人民法院對專利權進行財產保全,應當向國務院專利行政部門發出協助執行通知書,載明要求協助執行的事項,以及對專利權保全的期限,並附人民法院作出的裁定書。
對專利權保全的期限一次不得超過六個月,自國務院專利行政部門收到協助執行通知書之日起計算。如果仍然需要對該專利權繼續採取保全措施的,人民法院應當在保全期限屆滿前向國務院專利行政部門另行送達繼續保全的協助執行通知書。保全期限屆滿前未送達的,視為自動解除對該專利權的財產保全。
人民法院對出質的專利權可以採取財產保全措施,質權人的優先受償權不受保全措施的影響;專利權人與被許可人已經簽訂的獨占實施許可合同,不影響人民法院對該專利權進行財產保全。
人民法院對已經進行保全的專利權,不得重復進行保全。
第十四條 2001年7月1日以前利用本單位的物質技術條件所完成的發明創造,單位與發明人或者設計人訂有合同,對申請專利的權利和專利權的歸屬作出約定的,從其約定。
第十五條 人民法院受理的侵犯專利權糾紛案件,涉及權利沖突的,應當保護在先依法享有權利的當事人的合法權益。
第十六條 專利法第二十三條所稱的在先取得的合法權利包括:商標權、著作權、企業名稱權、肖像權、知名商品特有包裝或者裝潢使用權等。
第十七條 專利法第五十六條第一款所稱的「發明或者實用新型專利權的保護范圍以其權利要求的內容為准,說明書及附圖可以用於解釋權利要求」,是指專利權的保護范圍應當以權利要求書中明確記載的必要技術特徵所確定的范圍為准,也包括與該必要技術特徵相等同的特徵所確定的范圍。
等同特徵是指與所記載的技術特徵以基本相同的手段,實現基本相同的功能,達到基本相同的效果,並且本領域的普通技術人員無需經過創造性勞動就能夠聯想到的特徵。
第十八條 侵犯專利權行為發生在2001年7月1日以前的,適用修改前專利法的規定追究民事責任;發生在2001年7月1日以後的,適用修改後專利法的規定追究民事責任。
第十九條 假冒他人專利的,人民法院可以依照專利法第五十八條的規定追究其民事責任。管理專利工作的部門未給予行政處罰的,人民法院可以依照民法通則第一百三十四條第三款的規定給予民事制裁,適用民事罰款數額可以參照專利法第五十八條的規定確定。
第二十條 人民法院依照專利法第五十七條第一款的規定追究侵權人的賠償責任時,可以根據權利人的請求,按照權利人因被侵權所受到的損失或者侵權人因侵權所獲得的利益確定賠償數額。
權利人因被侵權所受到的損失可以根據專利權人的專利產品因侵權所造成銷售量減少的總數乘以每件專利產品的合理利潤所得之積計算。權利人銷售量減少的總數難以確定的,侵權產品在市場上銷售的總數乘以每件專利產品的合理利潤所得之積可以視為權利人因被侵權所受到的損失。
侵權人因侵權所獲得的利益可以根據該侵權產品在市場上銷售的總數乘以每件侵權產品的合理利潤所得之積計算。侵權人因侵權所獲得的利益一般按照侵權人的營業利潤計算,對於完全以侵權為業的侵權人,可以按照銷售利潤計算。
第二十一條 被侵權人的損失或者侵權人獲得的利益難以確定,有專利許可使用費可以參照的,人民法院可以根據專利權的類別、侵權人侵權的性質和情節、專利許可使用費的數額、該專利許可的性質、范圍、時間等因素,參照該專利許可使用費的1至3倍合理確定賠償數額;沒有專利許可使用費可以參照或者專利許可使用費明顯不合理的,人民法院可以根據專利權的類別、侵權人侵權的性質和情節等因素,一般在人民幣5000元以上30萬元以下確定賠償數額,最多不得超過人民幣50萬元。
第二十二條 人民法院根據權利人的請求以及具體案情,可以將權利人因調查、制止侵權所支付的合理費用計算在賠償數額范圍之內。
第二十三條 侵犯專利權的訴訟時效為二年,自專利權人或者利害關系人知道或者應當知道侵權行為之日起計算。權利人超過二年起訴的,如果侵權行為在起訴時仍在繼續,在該項專利權有效期內,人民法院應當判決被告停止侵權行為,侵權損害賠償數額應當自權利人向人民法院起訴之日起向前推算二年計算。
第二十四條 專利法第十一條、第六十三條所稱的許諾銷售,是指以做廣告、在商店櫥窗中陳列或者在展銷會上展出等方式作出銷售商品的意思表示。
第二十五條 人民法院受理的侵犯專利權糾紛案件,已經過管理專利工作的部門作出侵權或者不侵權認定的,人民法院仍應當就當事人的訴訟請求進行全面審查。
第二十六條 以前的有關司法解釋與本規定不一致的,以本規定為准。

專利的法律含義:

專利是受法律規范保護的發明創造,它是指一項發明創造向國家審批機關提出專利申請,經依法審查合格後向專利申請人授予的在規定的時間內對該項發明創造享有的專有權。

專利權是一種專有權,這種權利具有獨占的排他性。非專利權人要想使用他人的專利技術,必須依法徵得專利權人的同意或許可。

一個國家依照其專利法授予的專利權,僅在該國法律的管轄的范圍內有效,對其他國家沒有任何約束力,外國對其專利權不承擔保護的義務,如果一項發明創造只在我國取得專利權,那麼專利權人只在我國享有獨占權或專有權。

The appearance design has been primarily verified by the Intellectual Property Department according to the Patent Law of the People's Republic of China.
