『貳』 關於發明專利

我覺得肥皂紙這個還有戲（前提是市面上沒有類似產品），至於火柴盒捲尺，除非你在結構上比現有方式有明顯創新，否則不大容易授權的。
折射望遠鏡和反射潛望鏡估計難以授權，這兩個的原理恐怕不是那麼容易有突破性創新的。
申請專利要考慮有沒有市場價值，能不能轉化生產，畢竟每年的專利年費還是要繳納的，如果不能實現經濟效益，年費都是白白交了的。

『叄』 新疆奎屯有哪些主流媒體

為隆重紀念第十個「世界知識產權日」，辦好全國第七個保護知識產權宣傳周活動，奎屯市知識產權局在奎屯市、農七師電視台、奎屯市廣播電台和《北疆晨報》開設了知識產權宣傳周專欄，力求全方位、立體化報道奎屯市依靠技術創新獲得知識產權保護,從而走上創業之路的科技創新企業和專利發明人。此次活動重點采訪了五家企業和發明人，並在宣傳周期間連續播出。這五家企業在奎屯市知識產權局的大力鼓勵和扶持下，通過自主研發的新技術、新產品、新工藝獲得了自主知識產權，使企業從無到有、由小變大，由弱漸強，經過幾年至十幾年的持續創新和發展，有的已成為創產值幾百萬乃至上千萬元的企業，其中一名發明人被評為奎屯市創業之星。通過保護知識產權權宣傳周活動，大力宣傳報道奎屯市近年來涌現出的創新型人才和企業的典型事例，有效激勵了全市企業尊重創造、依靠創新的意識，引導企業成為創新的主體，從而提高企業的核心競爭力。

『肆』 新疆姐弟倆小發明獲國家專利證書，他們究竟發明了什麼

新疆姐弟倆小發明獲國家專利證書，姐姐曼曲古麗發明了一個隨身吸附式口罩，而弟弟瑪赫健則是發明了一個卷簾式屏風擋板。實話實說，這兩姐弟這么小的年齡就能想出這么好的點子，實在是也值得令人誇獎，更何況他們這些小發明還能夠解決生活中的實際問題。少年強，則中國強，我們為這兩姐弟點個贊吧！

少年強則中國強，現在這些年輕人能夠年紀小小就想出一些有用的發明，以後如果給了他們更高的平台，他們將能發明更多。我們現在很多人關注著這姐弟倆，也只是因為他們的發明實在是過於有用，而且他們兩個的年齡也有點小，他們的發明行為是值得讓人誇贊的。

綜合以上種種，所謂新疆姐弟倆小發明獲國家專利證書是姐姐發明了吸附式口罩，而弟弟則發明了卷簾式屏風擋板，這可真的是一個令人高興的事情。

『伍』 同一天申請的兩份發明專利權利要求有部分是相同的，可以嗎

可以來的，只要不是自完全一樣的技術方案就可以同時申報的，專利看的是整體，不是看其中一點。
專利法規定如下：

第三十一條 一件發明或者實用新型專利申請應當限於一項發明或者實用新型。屬於一個總的發明構思的兩項以上的發明或者實用新型，可以作為一件申請提出。
一件外觀設計專利申請應當限於一項外觀設計。同一產品兩項以上的相似外觀設計，或者用於同一類別並且成套出售或者使用的產品的兩項以上外觀設計，可以作為一件申請提出。

『陸』 發明專利怎麼弄

把握專利申請時間
我國專利法第九條規定："兩個以上的申請人分別就同樣的發明創造申請專利的，專利權授予最先申請的人"。根據這一規定，企業應該選擇好申請的時間，通常情況下越早越好。
1、專利申請要求優先權時間。我國專利法第二十九條規定，要求優先權的應該在首次申請之日起十二個月內提出。根據這一規定，企業如果欲要求優先權，將有十二個月的主動掌握時間。
2、專利申請公開時間。我國專利法第三十四條規定："國務院專利行政部門收到發明專利申請後，經初步審查認為符合本法要求的，自申請日起滿十八個月，即行公布。國務院專利行政部門可以根據申請人的請求早日公布其申請"。根據這一規定，企業可以選擇是否請求早日公布，從而選擇"縮短"還是"用盡"十八個月的時間。
3、發明專利申請實審請求時間。我國專利法第三十五條第一款規定："發明專利申請自申請之日起三年內，國務院專利行政部門可以根據申請人隨時提出的請求，對其申請進行實質審查;申請人無正當理由逾期不請求實質審查的，該申請即被視為撤回"。根據這一規定，企業將有三年的主動掌握時間。
對審查意見通知書的答復時間。根據我國專利法第三十七條的規定，申請人答復第一次審查意見通知書的時間一般為四個月，答復第二次及以後審查意見通知書的時間一般為兩個月，根據專利法實施細則第七條第三款的規定，申請人還可以申請一般為兩個月的延長期。這些規定為申請人提供了數月可主動掌握的時間
（三）積極提交發明專利申請所需材料
我國專利法第三十六條第一款規定："發明專利的申請人請求實質審查的時候，應當提交在申請日前與其發明有關的參考資料"。專利法實施細則第四十八條還規定："自發明專利申請公布之日起至公告授予專利權之日前，任何人均可以對不符合專利法規定的專利申請向國務院專利行政部門提出意見，並說明理由"。企業應該學會運用上述規定，當企業急於獲得專利權時，應該主動提交相關資料以幫助審查員更快地對是否能授予專利權作出判斷;當競爭對手的專利公布後，應積極研究，力求從中發現不具備專利性或不符合專利法要求之所在，及時
向專利審查部門提供證明，給該專利申請的最終授權設置障礙，或延緩該專利申請授權成功。
（四）辦理發明專利申請應當提交必要的發明專利申請文件，並按規定繳納費用。
發明專利申請必須採用書面形式或者電子申請的形式辦理,不能用口頭說明或者提供樣品或模型的方法，來代替或省略書面申請文件,在發明專利審批程序中只有書面文件才具有法律效力。專利申請的過程
(1)提交專利申請材料,包括專利申請書、專利申請委託書、專利申請權利要求書、專利申請技術背景及產品說明書等
(2)接收國家專利局下達的專利申請受理通知書
(3)發明專利申請應在規定時間內繳納實審費用,提請國家專利局進行實質審查
(4)國家專利局對專利申請進行審查,對合格的專利申請依法授權(5)專利申請人辦理專利授權登記手續領取專利證書其它在申請前應注意的事項
為了保證專利申請具有新穎性，在提出專利申請以前，申請人應當對申請內容保密。如果在發明試驗或鑒定的過程中有其它人參與，應當要求這些人員也予以保密，必要時可以簽訂保密協議。已由國務院主管部委或全國性學術團體組織或舉辦過新技術、新產品鑒定會和技術會議的，為了不喪失新穎性，應當按照專利法第24條的規定，在鑒定會或技術會議後6個月之內提出申請。
凡是要申請專利的項目涉及到一種或幾種新的公眾無法得到的微生物的，應當在提出申請以前，最遲在申請的同時將這微生物提交專利局指定的保藏單位保存。目前在國內已指定的保藏單位有：中國微生物菌種保藏管理委員會普通微生物中心，地址在北京中關村;中國典型培養物保藏中心，地址在武漢珞珈山武漢大學校內。同時，這兩個保藏單位又是布達佩斯條約指定的微生物國際保藏單位，所以申請人在這兩個單位保藏微生物的手續也將得到其它布希佩斯條約締約國的承認。
如果申請權是通過轉讓獲得的，應當在申請以前辦好轉讓手續，以便專利局需要時，可以及時提交。
◆一般來說，大型企業注重知識產權的發展，會專門設定知識產權部門，專利的申請會由專人負責，但是更多的企業，由於本身的發展限制，實質上並不具備專利文書等方面的申請程序，若有不慎，則會導致該技術的泄露，造成不利影響，所以，如果企業本身不擁有專業的人員，建議還是要專業的代理公司申請專利，費用雖然較自己申請高，但是，保證了申請的質量與技術的保密，有關代理公司的真實性，可以到中國專利局的官方網站查詢到該代理機構的代碼與存在年限等資料，可以作為判斷的標准。
